Distance Sales Agreement
DISTANCE SALES CONTRACT
This Distance Selling Agreement (“Agreement”) has been established electronically between the BUYER and the SELLER, whose information is given below, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation.
1. PARTIES
SELLER: [Company Name, Address, Phone, Email, MERSİS/Tax Number]
BUYER: [Name-Surname/Title, Address, Telephone, Email]
2. SUBJECT OF THE CONTRACT
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product/service, the features and sales price of which are specified below, which the BUYER ordered electronically from the SELLER's website.
3. PRODUCT/SERVICE INFORMATION
Product/Service Type, Quantity, Sales Price, Total Amount Including VAT are specified at the time of ordering.
4. DELIVERY
The product will be delivered to the address specified by the BUYER when ordering, and to the person/organization specified by the BUYER. Delivery time is 14 days at the latest from the date of order confirmation.
5. PAYMENT TERMS
BUYER pays for his order using credit card, debit card or other payment methods under the conditions specified on the SELLER's website.
6. RIGHT OF WITHDRAWAL
The BUYER has the right to withdraw from the contract within 30 days from the date of receipt of the product, without giving any reason and without paying any penalty. To exercise the right of withdrawal, written notice must be sent to the SELLER within this period.
7. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED
The right of withdrawal cannot be exercised for products prepared at the BUYER's request or clearly in line with his/her personal needs, or for products that deteriorate rapidly or have expired.
8. RETURN CONDITIONS
When the BUYER exercises his/her right of withdrawal, he/she returns the products to the SELLER. The SELLER will refund the price of the returned product within 30 days of receiving it.
9. FORCE MAJEURE
Circumstances that develop beyond the control of the parties, are unforeseen and prevent the parties from fulfilling their obligations (natural disaster, war, fire, strike, etc.) are considered force majeure.
10. DISPUTE RESOLUTION
In disputes arising from this contract, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence or the SELLER's place of residence are authorized within the monetary limits declared by the Ministry of Trade.
11. ENFORCEMENT
BUYER declares that he/she has approved this Agreement electronically and has read, understood and accepted the terms of the agreement.
